That is what makes a tenant notice to vacate Dubai a legal step rather than a courtesy — Article 14 of Dubai’s tenancy law treats silence as an intention to continue, and the lease then renews automatically on the same terms. Timing is only half of it. When to Send Notice: Dubai’s 90-Day Rule

A tenant notice to vacate Dubai has one clear deadline. Article 14 of Law No. (26) of 2007, as amended by Law No. (33) of 2008, states that a party wishing not to renew the contract or to amend any of its terms must notify the other party no less than ninety (90) days before the contract expires, unless the parties agree otherwise.

Three points people get wrong about that number:

  • It is a minimum, not a target. Ninety days is the floor. Sending your renewal notice at 120 days is safer and never invalid.
  • You count backwards from the expiry date, not from the day you plan to move your furniture.
  • Your contract can change it. The law says “unless the parties agree otherwise,” so a clause in your own lease setting 60 or 30 days can apply instead. Read your renewal clause before you count.

The same 90-day rule works in both directions. A landlord who wants to raise the rent or change any term for the next period is bound by it too — which is why the date on your contract matters more than the date on your calendar.

What the Law Requires in the Notice Itself

Getting the format right is what makes the notice enforceable if it is ever questioned:

  • Put it in writing. A verbal conversation or a passing WhatsApp message is far weaker evidence than a properly drafted written notice.
  • Serve it through a Notary Public or by registered mail. These are the methods the law names, and they create the proof of service that decides disputes.
  • Reference your Ejari number and contract dates. A notice that states the start date, expiry date and Ejari registration leaves no room to argue about which contract you meant.
  • Keep a copy and the proof of service. Keep the stamped notice, the courier receipt, or the notary record — not just the text you sent.

If the term expires and you keep occupying the property without objection, the tenancy generally continues on the same terms rather than ending. That can suit a tenant who wants to stay — but it is a trap if you had already planned to leave and assumed the lease would simply lapse. Is There a Penalty for a Late Renewal Notice?

There is no statutory fine for sending your notice late. The cost is different and often larger: your contract auto-renews for another term, and you can be held to the rent for that period even after you have moved into a new home. Separately, Ejari registration and renewal are administrative obligations handled through the Dubai Land Department, with their own fees and procedures — a late notice and a late Ejari renewal are two different problems, and it is worth not confusing them.

Common Mistakes Tenants Make When Not Renewing

  • Assuming the lease ends on its own. Without notice, most contracts renew — even if you have already signed somewhere else.
  • Counting 90 days from the wrong date. Count back from the contract expiry date on your Ejari, not from your intended move-out day.
  • Relying on a verbal or WhatsApp notice. Hard to prove if the landlord later denies receiving anything.
  • Leaving out the Ejari number and exact contract dates. Vague notices are the easiest to challenge.
  • Keeping the message but not the proof of service. Months later, the receipt is the part that matters.
